FWI Logistics Private Security, S.A. de C.V. (the ” Responsible” and/or “Overhaul”), with registered address at Boulevard Manuel Ávila Camacho 3130 – 1st floor, Offices 5, 6, and 7, Valle Dorado, Tlalnepantla, Zip Code 54020, State of Mexico, is the Responsible of your personal data.

2. Personal Data Collected

In order to establish a legal relationship between Overhaul and the Data Subject, Overhaul will collect the following categories of Personal Data:

a) Identification data,
b) Contact information,
c) Tax and/or asset data,
d) Images, videos, and sounds from video surveillance cameras at Overhaul’s facilities.

3. Sensitive Personal Data

Overhaul does not collect sensitive personal data; if necessary, your express consent will be requested for such purposes. Any other data you provide us that is not required in accordance with this Privacy Notice will be immediately deleted from Overhaul’s databases.

4. Purposes of Processing

In order to establish a legal relationship between Overhaul and the owner of the data, Overhaul will process Personal Data for the purposes described below:

a) PRIMARY PURPOSES.

  1. Quotation and provision of security logistics services, advisory services, auditing, and verification of security compliance, consulting and auditing in security logistics, security system solutions that operate through global satellite positioning, private security services that include the provision of protection and surveillance services for locations and facilities, safekeeping and custody of goods and during their transportation, excluding armed security.
  2. Sending information regarding the status of the contracted service and/or product, as well as tracking them through our platforms.
  3. Managing and processing payments for services and/or products.
  4. Issuing the corresponding tax receipts for the contracted services and/or products.
  5. Managing and allowing access to your account, if you register on any of Overhaul’s web platforms.
  6. Processing and responding to your requests if you contact our customer service department.
  7. Overhaul may conduct video surveillance inside and around its facilities to preserve and guarantee the security of its facilities and those of Overhaul.

b) SECONDARY PURPOSES. Overhaul may also process Personal Data for purposes that do not give rise to a legal relationship between Overhaul and the owner of the Data, nor are they necessary for the existence of a legal relationship between Overhaul and owner of the Data. These purposes include:

  1. Conducting surveys to evaluate the quality of the services and/or products provided by Overhaul.
  2. Sending you information regarding our services, products, and promotions by various means.
  3. Inviting you to participate in raffles, sweepstakes, contests, events, and benefit programs.

If you do not wish your personal data to be processed for any of the purposes described in this section, please send an email to [email protected] . If you do not express your refusal to process your personal data within a period of 5 (five) business days, it will be understood that you have given your consent.

5. Use of Cookies and Other Technologies

Overhaul uses cookies and other tracking mechanisms to track information about your use of our Websites, platforms, applications, and/or services (hereinafter “the Sites”). Overhaul may combine this information with other personal information we collect about you.

This Privacy Policy applies only to information collected by Overhaul’s Sites and applications.

In order to adequately provide the service, Overhaul may transfer or forward your personal data to Overhaul’s subsidiaries, affiliates, or parent company. It is understood that your personal data will always be treated in accordance with the consent granted in this Privacy Notice and that said subsidiaries and affiliates operate under the same personal data protection policies as Overhaul and are always subject to confidentiality obligations.

Likewise, your personal data may be transferred if necessary to comply with the law or upon a duly substantiated and reasoned request from a competent authority. At all times, Overhaul will ensure that the information disclosed is strictly necessary in accordance with the law or the request.

Overhaul will notify you personally of any other transfer of personal data that it intends to make and requires your consent so that you can consent or deny such consent.

7. Exercise of ARCO Rights

In those cases where legally applicable, you may exercise your rights of access, rectification, erasure, and objection (ARCO rights) at any time through the procedures we have implemented.

The corresponding request must comply with the requirements established in current legislation, by writing to FWI Logistics Private Security, S.A. de C.V., at the address located at: Boulevard Manuel Ávila Camacho 3130 – 1st floor, Offices 05, 06, and 07, Col. Valle Dorado, Tlalnepantla, Zip Code 54020, State of Mexico.

The request must contain and be accompanied by the following:

a) Your name and full address or other means of communicating the response to your request.

b) Documents proving your identity or, where applicable, legal representation.

c) A clear and precise description of the personal data for which you seek to exercise any of the ARCO Rights; and

d) Any other element or document that facilitates the location of the personal data.

Overhaul will notify you of the decision made within a maximum period of 20 (twenty) work days from the date it receives the corresponding request. If the request is admissible, it will be effective within 15 (fifteen) work days following the date on which Overhaul communicates its response.

If the information provided in your request is erroneous or insufficient, or if the necessary documents to prove your identity or the corresponding legal representation are not included, Overhaul will, within 5 (five) work days following receipt of your request, request that the deficiencies be corrected in order to process it. In these cases, you will have 10 (ten) work days to address the request for correction, starting on the day after you received it. The corresponding request will be considered not submitted if you do not respond within this period.

You may obtain the requested information or personal data through simple copies, electronic documents in conventional formats (Word, PDF, etc.), through restricted and authorized access to the system that processes your personal data (access), or through any other legitimate means that guarantees and proves the effective exercise of the requested right.

Alternatively, the owner of the Data may direct their request to the following address: [email protected] , complying with all the requirements listed above, and stating “ARCO Rights and/or Revocation of Consent” as the subject of the communication. The procedural timeframes will be the same as those referred to in the immediately preceding paragraph. The use of electronic means to exercise ARCO rights authorizes Overhaul to respond to the corresponding request through the same means, unless the data subject clearly and expressly indicates otherwise.

You will be responsible for keeping your personal data in Overhaul’s possession up-to-date. Therefore, you guarantee and are responsible, in all cases, for the truthfulness, accuracy, validity, and authenticity of the personal data provided, and you undertake to keep it duly updated, communicating any changes to Overhaul.

9. Means to Limit the Disclosure or Use of Your Personal Data
